Achievements | Zhonglun W&D Lawyer Jie Yao Achieves 82% Reduction in Involved Amount Through Exceptional Defense, Securing Probation for Client

Recently, the court ruled on a major economic criminal case defended by Jie Yao, a lawyer at our firm. The final amount attributed to the client was 82% lower than the sum initially determined by the police at the time of detention, and the client was successfully granted probation. Lawyer Yao’s exceptional defense delivered profound legal and social effects.

This case is classified as a major criminal offense, involving multiple provinces, municipalities, and autonomous regions across the country, with an exceptionally large sum of money involved and a significant number of implicated individuals. Lawyer Yao took on the case during the stage of review and prosecution. Through reviewing the case files, Lawyer Yao discovered that the amount of money attributed to the client by the public security authorities was as high as tens of millions of yuan. If the criminal facts were determined based on this figure, the client would face extremely severe consequences.

Lawyer Yao promptly reviewed the relevant evidence, cross-checked the facts with the client, and conducted extensive case research, concluding that the police’s determination of the involved amount lacked sufficient proof. Combining relevant judicial interpretations of the law, he formulated defense arguments and submitted them to the procuratorate, requesting a reduction in the alleged amount. The procuratorate adopted his arguments, cutting the amount by nearly half.

While this interim victory boosted the client’s confidence, the remaining sum is still in the tens of millions yuan, which was still highly unfavorable. Undeterred, lawyer Yao meticulously re-examined the case and identified further inaccuracies in the prosecution’s calculations. He filed a request for critical evidence, ultimately leading the procuratorate to slash the amount to several million yuan. Through her relentless efforts, lawyer Yao achieved an 82% reduction in the alleged amount.

At trial, thanks to lawyer Yao’s thorough preparation, the proceedings proceeded smoothly for his client, who expressed high praise for his work. Notably, lawyer Yao was the only defense lawyer who argued for a lighter or mitigated penalty for accessories. He presented detailed reasoning—both subjectively and objectively—as to why the client deserved a reduced penalty. The court adopted his arguments and applied it to all co-defendants, imposing the minimum fines across the board.

Min Li, the firm’s Vice Director and Executive Committee Chair, participated throughout the case. From the outset, he emphasized scrutinizing the client’s personal accounts and distinguishing the legal implications of each transaction—a strategy that proved pivotal to the defense. His sharp legal acumen was instrumental in shaping the case.

Additionally, the firm’s Director Yuqin Xia, provided full support, laying a solid foundation for the successful defense.
