Duan Qingxi is a partner of Zhonglun W&D Law Firm Shanghai Office, head of the Litigation and Arbitration Department of the Shanghai Office, deputy director of the Maritime Law Legal Committee, deputy director of the Bankruptcy Reorganization Legal Committee, and a member of the Research Committee of Derivative Litigation of Shanghai Bankruptcy Administrators Association. His areas of expertise include dispute resolution, international trade, bankruptcy reorganization and liquidation. Representative clients include well-known shipping state-owned enterprises, port enterprises, manufacturing export enterprises, bulk cargo traders, restaurant chains, etc. He serves as an arbitrator for a number of arbitration institutions and focuses on domestic and international commercial litigation and arbitration.
Working Experience
Representation of a well-known domestic bus industry Co., Ltd. in an arbitration against a Saudi company in a dispute over an automobile export sales contract with a subject matter value of about US$30 million, which was arbitrated by the Shanghai Branch of CIETAC;
◎ Representation of a Chinese steel structure exporter in a steel structure export contract dispute with a bridge project joint venture in India, with a subject matter value being about USD 80 million, arbitration in New Delhi, India, which involves various issues such as manufacture and supply contract, carriage of goods by sea, letter of credit, letter of guarantee, and court restraint order against fraudulent encashment of the bank guarantee;
◎ Representation of a shipyard in Taizhou, Jiangsu Province in its dispute with a South Korean company in respect of a main engine import contract, CIETAC, with a subject matter value being appox RMB 130 million;
◎ Representation of a Singapore marine equipment manufacturer in an equipment supply contract dispute with a shipyard in South China, with a subject matter of more than S$5,000,000;
◎ Representation of a automile export company in Jiangsu in a dispute over cargo insurance contract for damage to its vehicles exported to Nigeria, with a cargo value of RMB 12 million;
◎ Representation of a domestic giant transportation project company in a dispute between it and a state-owned logistics company arising out of a contract for the transport of special giant goods in Vietnam, arbitrated by the Shanghai branch of CIETAC, with a subject matter value of over RMB80 million;
◎ Representation of a power supply technology company in Shenzhen against a Brazilian company in a battery sales contract dispute,arbitrated by CIETAC;
◎ Representation of a company in Zhejiang Province in handling an equity repurchase dispute with the subject matter value of over RMB30 million, lawsuits in courts of Zhejiang Province;
◎ Representation of the client in declaring credit in the bankruptcy and reorganization case of Sainty Shipyard and negotiate with the bankruptcy administrator on the acceptance and confirmation of the credit/claims, and attending the creditors' meeting on behalf of the client;
◎ Representation of a client in applying for the bankruptcy of its subsidiary as a creditor, and applying for participation in a creditor's claim confirmation lawsuit (Creditor v. Bankruptcy Administrator) on behalf of the client as a third party;
◎ Representation of a former executive of a Hong Kong-listed company in an equity compensation arbitration dispute between the client and the company's chairman of the board, arbitrated by the Shanghai Arbitration Commission ;
◎ Representation of a client in response to an individual discharge of debts suit filed by the bankruptcy administrator of a company;
◎ Representation of a creditor of a company in Shanghai in suing for the shareholder’s supplementary liability for the company's debts that cannot be discharged to the extent that they have not contributed to the capital;
◎ Representation of chief executives of several companies in applying to the court for lifting of Restrictive Order;
◎ Representation of a Chinese importer(buyer) to succeed in applying for the court’s freezing order against the fraud in letter of credit committed by a Brazilian;
◎ Acting as legal advisor for clients.
