Mr. Ruan Chen is a partner at Zhonglun W&D Law Firm. With an interdisciplinary educational background in engineering and law, he earned a Master of Science degree in Mechanical Engineering from the University of Shanghai for Science and Technology, and later obtained a Master of Laws (LL.M.) degree from East China University of Political Science and Law. He holds both lawyer practicing qualification and patent attorney practicing qualification in China.

Achievements

Representative Litigation Cases:

  • Represented a medical device enterprise in a trade secret infringement dispute arising from employee job-hopping. As counsel for the defendant, he successfully proved "passive use" of the alleged trade secret, reducing the awarded compensatory damages from over RMB 80 million claimed by the plaintiff to RMB 600,000. This case was selected by the Shanghai High People's Court into three authoritative case collections: 2024 Typical Cases of Intellectual Property Judicial Protection by Shanghai Courts for the Development of New Quality Productive Forces, 2025 Typical Cases of Serving and Guaranteeing Shanghai's Deepening of the Construction of an International Science and Technology Innovation Center, and 2026 Typical Cases of Trade Secret Protection by Shanghai Courts.
  • Represented a chemical enterprise in rights protection against a competitor that colluded with suppliers to infiltrate the factory and steal technical secrets. His work included filing a criminal report, coordinating with forensic appraisal institutions to conduct technical secret appraisal, facilitating the public security organ’s criminal case filing and case transfer for examination and prosecution, and representing the victim entity in criminal proceedings with an incidental civil action filed. The first-instance judgment ruled that the defendants bear criminal liability and pay RMB 5 million in civil compensation.
  • Represented the defendant in an invention patent infringement dispute involving industrial robot technology and the related patent invalidation proceedings. He filed a request for patent invalidation declaration with the China National Intellectual Property Administration (CNIPA) against the patent in suit, successfully obtained a ruling declaring the patent invalid, and secured a favorable judgment in the subsequent administrative litigation over the patent invalidation decision.
  • Represented the defendant in a patent ownership dispute filed by a competitor of a special materials enterprise, who alleged that a job-hopping employee had disclosed its technical secrets. As defense counsel, he pointed out that the technical secrets claimed by the plaintiff were not supported by corresponding carrier evidence, thus negating the basis of the plaintiff’s claim, and eventually forced the plaintiff to withdraw the lawsuit.
  • Represented a headhunting company in filing a report with the administrative authority against an employee who illegally scraped the company’s talent database via technical means. He prompted prompt enforcement action by the authority, timely halted the ongoing illegal act, and effectively prevented further damage.
  • Represented a domestic industrial equipment manufacturer in a patent infringement dispute with a foreign industry giant. He filed a request for patent invalidation declaration with the CNIPA against the patent in suit, and successfully obtained a ruling invalidating the patent held by the foreign enterprise.
  • During his tenure at United Imaging Healthcare, he deeply participated in responding to a series of patent disputes between United Imaging Healthcare and Siemens Healthineers, contributing to the company’s strategic success in the high-end medical equipment industry competition.

Representative Non-litigation Projects:

  • Provided IP counseling services for a Class A tertiary hospital in Shanghai, assisting with the management and transformation of its IP achievements. The work included optimizing the hospital’s internal IP management and transformation procedures, delivering specialized training on IP management and transformation of medical research achievements, supporting IP portfolio layout, filing and right confirmation for specific research projects, and facilitating hospital-enterprise cooperation to realize the industrialization of research outcomes. Multiple hospital-enterprise cooperative research transformation projects have been completed under his assistance.
  • Led the Freedom to Operate (FTO) analysis for a medical device investment and financing project, delivered the analysis report and presented findings to both the investment institutions and the financed enterprise, which was well recognized by both parties.
  • Entrusted by the investor to conduct IP due diligence on the target company in a technology firm M&A project, provided accurate reminders on IP ownership and infringement risks, and received positive recognition from the investor.
  • Led FTO analysis for multiple product projects of a well-known consumer electronics company, and assisted the client in formulating design-around solutions to address patent infringement risks.
  • Provided specialized legal services on compliance building for the IP protection management system and the trade secret protection management system for a large technology enterprise.
  • During his tenure at Fosun Group, he provided IP support for multiple medical tech startups invested and incubated by Fosun. He established IP working procedures and institutional norms from scratch for Fosun Xingmai, Fosun’s first AI medical technology company, completed patent mining and portfolio layout of over 100 patent applications for Fosun Xingmai from zero, promoted scientific research cooperation with external parties including medical institutions and research institutes and took charge of related IP management, and advanced compliance assessment and system improvement for medical data security and personal information protection.
  • During his tenure at United Imaging Healthcare, he was fully responsible for all patent-related work of the CT Business Division, including patent mining and global portfolio layout, patent infringement risk screening against competitors, formulation of patent infringement risk response plans, and preparation and support for patent litigation.
